KLSCM 2026 Official Photography Partner — Terms & Conditions

By submitting an application to be a KLSCM 2026 Official Photography Partner, you ("the Photographer") agree to be bound by the following Terms & Conditions.

1. Definitions

  • "KLSCM" refers to the Kuala Lumpur Standard Chartered Marathon 2026, held on 3 – 4 October 2026, within the Kuala Lumpur city centre.

  • "Dirigo Events" refers to [Dirigo Events Sdn Bhd], the organiser of KLSCM.

  • "the Platform" refers to [Ticket2U], the official channel through which KLSCM race-day photographs are listed and sold to the public.

  • "Official Photos" refers to all photographs taken by the Photographer at KLSCM, using their race-day accreditation and route access, during the official event period.


2. Eligibility & Application

2.1 Applicants must submit a completed KLSCM 2026 Official Photography Partner Registration Form, including a portfolio of prior event or sports photography work, by 15 September 2026.

2.2 Dirigo Events reserves the right to accept or decline any registration at its sole discretion, and is not obliged to provide reasons for a decline.

2.3 Accepted Photographers will be notified by 25 September 2026 and issued official race-day accreditation ahead of race weekend.


3. Accreditation & Route Access

3.1 Accreditation grants the Photographer access to designated route positions and shooting zones on race day, as assigned by Dirigo Events or mutually agreed upon.

3.2 Accreditation is non-transferable and valid only for KLSCM 2026. It must be worn/displayed visibly at all times while on the course.

3.3 Photographers must wear the provided high visibility photographer vest at all times while on the course.

3.4 Photographers must comply with all instructions from race marshals, safety officers, and Dirigo Events staff, including restrictions on standing positions, timing mats, and runner pathways.

3.5 Dirigo Events reserves the right to revoke accreditation on-site for non-compliance or conduct that endangers runners, staff, or the public.


4. Ownership of Photos

4.1 The Photographer retains copyright in the Official Photos.

4.2 The Photographer grants Dirigo Events a perpetual, worldwide, royalty-free licence to use, reproduce, edit, publish, distribute and archive the Official Photos for KLSCM marketing, publicity, reporting, sponsorship, commercial and historical purposes. Dirigo Events may provide and sublicense the Official Photos to Standard Chartered Bank, event sponsors, partners, media organisations, agencies and service providers for these purposes

4.3 The Photographer may use Official Photos for their personal portfolio and self-promotion, provided that such use does not suggest an endorsement, sponsorship or official commercial relationship beyond their appointment for KLSCM 2026.


5. Sale of Photos & Commission

5.1 All Official Photos intended for commercial sale must be uploaded to and sold exclusively through the Platform for a period of three (3) months after KLSCM 2026. During this period, the Photographer must not sell, license, upload or otherwise distribute such photographs commercially through any other website, platform, social media account or channel without Dirigo Events’ prior written consent.

5.2 The Photographer must upload all commercially suitable Official Photos to the Platform within forty-eight (48) hours after the relevant Event day, unless otherwise agreed by Dirigo Events in writing.

5.3 The Photographer will receive 60% of the Net Sale Price of each Official Photo credited to the Photographer and sold through the Platform. “Net Sale Price” means the amount actually received from the customer after deducting refunds, chargebacks, payment gateway charges and third-party platform fees. The remaining 40% will be retained by Dirigo Events to cover platform, administration, customer-service and event-related costs.5.3 Commission earned from sales up to 31 October 2026 will be paid by bank transfer no later than 9 November 2026, subject to final sales, refund and chargeback reconciliation. Commission from any later sales during the three-month exclusivity period will be paid within thirty (30) days after the end of that period. The Photographer is responsible for providing complete and accurate bank-account details.


6. Runner Consent & Data Protection

6.1 Photography of participants at KLSCM is covered under the event's race entry terms, which participants agree to at registration.

6.2 Photographers must not photograph participants, staff, or members of the public in a manner that is intrusive, harassing, or outside the designated official shooting areas.

6.3 Any runner request to have their photo removed from sale must be forwarded to Dirigo Events promptly and honoured without charge.

6.4 Photographers must not upload images of medical incidents, persons in distress, or children in inappropriate or sensitive situations. Photographers must comply promptly with any instruction from Dirigo Events to remove an image.


7. Code of Conduct

7.1 Photographers must conduct themselves professionally at all times, and must not interfere with race operations, medical response, or runner safety.

7.2 Equipment, positioning, and movement on course must not create a hazard for runners, volunteers, or other photographers.

7.3 A breach of this Code of Conduct may result in immediate revocation of accreditation, removal from the Programme and removal of the Photographer’s photographs from the Platform. Termination will not affect commission properly earned from photographs sold before termination, subject to refunds, chargebacks and any losses arising from the Photographer’s breach.


8. Non-Accredited Photography

8.1 Only accredited Photographers under this Programme may access designated route positions for the purpose of commercial photography.

8.2 Dirigo Events reserves the right to take appropriate action, including legal action, against any party found to be photographing KLSCM participants for commercial sale outside of the Platform without accreditation and authorisation.


9. Term & Termination

9.1 This agreement is valid for the duration of KLSCM 2026, from the date of accreditation issuance to 31 October 2026 when sales end.

9.2 Either party may terminate participation with written notice. Dirigo Events may terminate immediately for breach of any of the Terms set out in this document.


10. Liability & Indemnity

10.1 The Photographer participates in being a Photography Partner at their own risk and is responsible for their own equipment, insurance, and safety on-course.

10.2 The Photographer agrees to indemnify Dirigo Events against claims arising from the Photographer’s conduct, including injury on course and damage to third-party property.

10.3 The Photographer is engaged as an independent contractor. Nothing in these Terms creates an employment, agency, partnership or joint-venture relationship between the Photographer and Dirigo Events.


11. Governing Law

These Terms are governed by the laws of Malaysia, and any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.

 

12. Amendments

Dirigo reserves the right to amend these Terms at any time. Material changes will be communicated to active Programme Photographers via [email protected].
